Cast Iron Type end user license agreement

Version 1.1. This is the license every Cast Iron Type font ships with, as LICENSE.txt in the download. It is proprietary, not open source (not OFL). Fonts bought on Creative Market are covered by Creative Market's own font license instead.

This is an agreement between you (the individual or organization that bought a license, "you") and Durable Programming, LLC, doing business as Cast Iron Type ("we"). It covers the font software you received with it: the font files in every format we supply (OTF, TTF, variable, WOFF2), any updates we provide, and the accompanying documentation (together, the "Font Software").

By installing, copying, or using the Font Software you accept these terms. If you do not accept them, do not use the Font Software.

The Font Software is licensed, not sold. We keep ownership of it and all intellectual property in it. You get the rights described below and no others.

1. What every license allows

Whatever license type you bought, you may:

1. a. Use the Font Software to make any number of designs, documents, and products, for yourself or for clients, commercial or not. The things you make (printed matter, images, videos, logos, packaging, signage, merchandise, and so on) are yours, and you may sell or distribute them without further payment to us.
2. b. Use the Font Software in a logo or trademark. We make no claim to your logo.
3. c. Embed the Font Software in PDF and other electronic documents, as long as the document is not a way of distributing the font itself and the font cannot be extracted from it for use elsewhere. Subsets are preferred.
4. d. Make backup copies for your own archival use.
5. e. Give a copy to a printer or service bureau that needs it to output your job, provided they use it only for that job and delete it afterwards.
6. f. Convert the Font Software into another format, or subset it, where your license type requires that (for example, for a website or an application), provided the result is used only as that license type allows.

2. License types

Your receipt shows which license type you bought. Each one adds to section 1 as follows.

Desktop

Install and use the Font Software on computers used by one (1) person. That person may install it on more than one computer they personally use.

Studio

As Desktop, for up to ten (10) people within one organization.

Webfont

Use the Font Software through @font-face (or an equivalent method) on the websites of one (1) domain and its subdomains, up to a combined 100,000 pageviews per month. If your site regularly exceeds that, you need an additional license. Self-hosted font files must be served only to that domain, with reasonable measures to prevent hotlinking from other domains. A Webfont license does not include desktop use.

Desktop + Web Bundle

A Desktop license and a Webfont license together.

App / Embedded

Embed the Font Software, in whole or as a subset, inside one (1) application title (desktop, mobile, web, or game), including all its versions, updates, and platform ports, so that it displays text in that application. The font must be embedded in a way that prevents end users from extracting it and installing or reusing it. This license does not include desktop use; buy a Desktop license for the people designing with it.

3. What no license allows

You may not:

1. a. Sell, give away, sublicense, lend, rent, or otherwise distribute the Font Software itself, on its own or bundled with anything else, except as section 1 (c), (e) and (f) and your license type allow.
2. b. Make the Font Software available on a shared drive, server, or network where people beyond those your license covers can use it.
3. c. Modify the outlines, or make a derivative font, and distribute or sell it. You may modify the letterforms within a specific design, such as a logo converted to outlines. Format conversion and subsetting under section 1 (f) are also allowed.
4. d. Use the Font Software, or anything made from it, to create or offer a product whose purpose is letting others set text in it: font-making or template-selling services, "type your own text" generators, print-on-demand systems where customers enter their own text, and similar. The App / Embedded license covers an application that uses the font for its own interface and content. Contact us for anything that lets end users set arbitrary text.
5. e. Use the Font Software, its outlines, or text rendered in it to train, fine-tune, or evaluate machine learning models that generate typefaces or letterforms.
6. f. Remove or change the copyright, trademark, or license information in the font files.

4. Client work

You may use a license you own to make work for clients and hand them the finished work. If your client wants to install or edit with the Font Software themselves, they need their own license. You may buy that license on your client's behalf, in which case the license belongs to the client.

5. Updates

Updates we release for the same typeface (fixes, added characters, completed scripts, new styles in the same family) during the one (1) year following your purchase are provided to you at no additional charge. We may, at our discretion, provide updates released after that year as well. Any update you receive is covered by this agreement. We are not obliged to release updates.

6. Transfer

You may transfer your license once, in full, to another party who agrees to these terms, if you tell us in writing and keep no copies. An organization may reassign a seat from one person to another, as long as the number of people using the Font Software at any time stays within the license.

7. Termination

This license lasts until it is terminated. It ends automatically if you breach these terms and do not fix the breach within thirty (30) days of our notice. When it ends you must stop using the Font Software and delete all copies. Work you produced while licensed stays yours.

8. Warranty and liability

The Font Software is provided "as is". We have made every effort to make it work correctly, and if you find a defect please tell us. But to the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Font Software. Our total liability under this agreement is limited to the amount you paid for the license.

Some jurisdictions do not allow these exclusions, in which case they apply only as far as permitted.

9. General

This agreement is governed by the laws of New Hampshire, without regard to its conflict-of-law rules. If any part of it is found unenforceable, the rest remains in effect. It is the entire agreement between us about the Font Software and replaces any earlier one. We may publish revised terms for future purchases; the terms you bought under continue to apply to your license.
